1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and So Design and Branding Pty Ltd (ABN 59 889 218 355) ("Company", "we", "us", or "our") governing your access to and use of PDF AA Compliance.com ("Service", "Platform").

By accessing or using PDF AA Compliance, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service following any changes constitutes acceptance of the modified Terms.

2. Service Description

PDF AA Compliance provides automated PDF accessibility remediation services designed to help make PDF documents compliant with accessibility standards including WCAG 2.1 AA, PDF/UA-1, Section 508, and ADA requirements.

Our services include, but are not limited to:

  • AI-powered document structure analysis
  • Automatic alt text generation for images
  • Document tagging and structure remediation
  • Accessibility validation and scoring
  • Compliance certificate generation

3. Important Disclaimer - Limitation of Remediation Services

YOU ACKNOWLEDGE AND AGREE THAT:

  • PDF AA Compliance is an automated solution that provides low-cost, high-volume PDF accessibility remediation using artificial intelligence and automated processes.
  • While we take all reasonable care in providing our services, we do not guarantee that remediated documents will achieve 100% accessibility compliance or pass all accessibility testing tools.
  • AI-generated content including alt text descriptions, document structure analysis, and accessibility assessments may contain errors, inaccuracies, or omissions.
  • Final responsibility for document accessibility compliance rests with you, the User. You are responsible for reviewing remediated documents and verifying their suitability before publishing or distribution.
  • Our validation and certification, while accurate to the best of our automated systems' abilities, should not be relied upon as the sole measure of accessibility compliance.
  • Complex documents including those with intricate layouts, mathematical equations, or specialized content may require additional manual review and remediation.

We strongly recommend that users with critical accessibility requirements engage professional accessibility consultants to review remediated documents before publication.

4. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and account
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

5. Payment Terms

PDF AA Compliance operates on a pre-paid page credit system. By purchasing page packs, you agree to:

  • Pay all applicable fees at the time of purchase
  • Page credits are valid for the period specified at purchase
  • Unused credits expire as per pack terms and are non-refundable
  • Prices are in US Dollars (USD) unless otherwise specified
  • All payments are processed securely through Stripe

GST for Australian Entities

For customers located in Australia, Goods and Services Tax (GST) at the applicable rate (currently 10%) will be added to all purchases in accordance with Australian tax law. GST-inclusive pricing is displayed when AUD currency is selected. A valid tax invoice will be provided for all purchases, which you may use for GST credit claims where applicable.

Refund Policy: Due to the immediate consumption of computational resources, page credits are generally non-refundable once purchased. Refunds may be considered at our discretion for documented service failures.

6. Prohibited Uses

You agree NOT to:

  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use the Service for any unlawful purpose
  • Upload documents containing malware, viruses, or malicious code
  • Upload documents containing illegal content
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Resell or redistribute the Service without authorization
  • Interfere with or disrupt the Service's operation
  • Use insights gained from the Service to develop competing products
  • Circumvent any security measures or access controls

7. Intellectual Property

Our Property: The Service, including all content, features, functionality, software, and technology, is owned by So Design and Branding Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of documents you upload. By uploading documents, you grant us a limited license to process them for the purpose of providing the Service. We do not claim ownership of your documents.

Trademarks: "PDF AA Compliance" and associated logos are trademarks of So Design and Branding Pty Ltd. You may not use these marks without written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
  • IN NO EVENT SHALL SO DESIGN AND BRANDING PTY LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless So Design and Branding Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Documents you upload to the Service
  • Your distribution or publication of remediated documents

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

Upon termination:

  • Your right to use the Service will immediately cease
  • Unused page credits may be forfeited
  • We may delete your account and associated data after a reasonable period
  • Provisions that should survive termination will remain in effect
